Legal Terms and Privacy Framework for OpenMDC

Legal Terms and Privacy Framework for OpenMDC governs all access, reference use, and public engagement across this civic transparency index. By accessing or using this site, you accept and agree to these terms. All information provided on this platform is published for general public transparency and civic reference.

Nothing in these terms limits, excludes, or modifies any non-excludable statutory rights or consumer protections guaranteed by the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 under New Zealand law.

Public Records and Council Disclaimers

OpenMDC is an independent community project operated by Goodwin and Associates Limited. This website is not an official publication of the Marlborough District Council, nor is it endorsed by, affiliated with, or formally connected to the council or its administration.

Voting records are compiled directly from publicly notified meeting agendas, approved council minutes, and voluntary written disclosures from elected members. While we exercise care to transcribe official records faithfully, OpenMDC does not warrant that every record is free from typographical errors, omissions, or interim administrative changes in council documents. Users should cross-reference official Marlborough District Council documentation for formal legal proceedings.

Privacy Policy and Edge Architecture

This Privacy Policy complies with the Information Privacy Principles set out in the New Zealand Privacy Act 2020:

  • Zero Personal Tracking: OpenMDC does not employ commercial advertising cookies, tracking pixels, or third-party marketing beacons. Browsing this site requires no personal registration or payment credentials.
  • Edge Infrastructure: This site runs on Cloudflare edge infrastructure. Cloudflare may process non-identifiable technical connection data - such as client IP addresses, browser headers, and system parameters - strictly to mitigate cyberattacks, prevent denial-of-service disruptions, and run cookieless aggregated web analytics.
  • Direct Inquiries: If you contact us via email or web form to flag an error or submit a voluntary voting record, your contact information is used strictly to resolve your query and verify primary source minutes. We do not sell, rent, or distribute personal communications to outside commercial entities.

Indigenous Data Sovereignty and Māori Cultural Rights

OpenMDC respects the principles of Indigenous Data Sovereignty and Te Tiriti o Waitangi. Third-party crawlers, algorithmic aggregators, and commercial artificial intelligence models are strictly prohibited from scraping or repurposing this repository to synthetically generate, replicate, or commercialise Māori cultural heritage, motifs, or ancestral insignia.

Under indigenous tikanga, artificial intelligence models cannot reflect genuine whakapapa (genealogy), wairua (spiritual essence), or mauri (vital life force). Tā moko and related cultural treasures (taonga) remain protected against automated replication.

Corrections and Data Governance
